- 1. Participation & Registration Bidders must register and be approved prior to bidding. Auctioneer may require identity verification and proof of funds. A refundable bidder deposit equal to 50% of intended bid limit is required to participate. Auctioneer reserves the right to refuse registration or bidding privileges at its sole discretion.
- 2. Reserve Auction This is a reserve auction. Seller and Auctioneer retain the right to accept or reject the highest bid.
- 3. Bidding Procedures Once submitted, bids cannot be withdrawn. Bidding increments will be determined by the platform and Auctioneer. Soft-close anti-sniping applies: bids placed within the closing seconds extend the auction time for that item.
- 4. “As-Is, Where-Is” Condition

- 5. Buyer’s Premium & Taxes A 10% buyer’s premium will be added to the hammer price. Applicable Canadian sales taxes (GST/HST/PST) apply based on the buyer’s province and tax status. Tax exemptions require valid documentation prior to invoicing.
- 6. Payment Terms Full payment is due within 72 hours of invoice. Accepted payment methods include wire transfer, certified funds, or other methods approved by Auctioneer.
- 7. Pickup, Removal & Storage Items must be removed within 7 days of payment. Buyer is responsible for all logistics, rigging, trucking, and transport. Failure to remove items within the required time will result in: storage fees charged daily potential forfeiture of items without refund Buyer assumes all risk and liability at time of payment.
- 8. Safety & Environmental Responsibilities Buyer assumes responsibility for safe handling, removal, and transportation of assets. Buyer agrees to comply with all applicable environmental, labor, and safety laws.
- 9. Title & Risk of Loss Title transfers only after: full payment received and cleared, and any required documents signed. Risk transfers to buyer immediately upon payment.
- 10. Default & Remedies If Buyer defaults, Seller and Auctioneer may: Retain deposit Resell items at Buyer’s expense Pursue legal recovery of losses and fees Block Buyer from future auctions
- 11. Technical Issues Auctioneer is not responsible for platform interruptions, connectivity issues, or bidding errors. Auctioneer may restart, extend, or cancel bidding if technical issues occur.
- 12. Governing Law These terms are governed by the laws of the province in which the asset is located, and Canadian federal law where applicable.
- 13. Acceptance of Terms By registering and bidding, the Bidder acknowledges and agrees to all terms and conditions herein.
